Terms of Service

1. Service Description

CompliaScan provides automated website accessibility scanning against WCAG 2.2 and related standards. The service identifies potential accessibility barriers using automated testing tools including axe-core and custom analysis.

2. Important Limitations & No Compliance Guarantee

CompliaScan is an automated scanning tool. Results are informational and do not constitute legal advice, certification, or a guarantee of compliance with the Americans with Disabilities Act (ADA), European Accessibility Act (EAA), Section 508, or any other accessibility law or regulation.

Automated testing can detect a significant portion of machine-testable WCAG criteria but cannot evaluate all accessibility requirements. Some success criteria require human judgment, manual testing, and assistive technology evaluation. A passing scan does not mean a website is fully accessible or legally compliant. A failing scan does not necessarily mean a website violates any law.

You acknowledge that CompliaScan scan results, scores, reports, and any related output cannot be used as evidence of compliance or non-compliance in any legal proceeding. We recommend using CompliaScan results as one input alongside manual accessibility audits, user testing with people with disabilities, and qualified legal counsel.

3. Acceptable Use

You agree to:

  • Only scan websites you own or have explicit authorization to scan
  • Not use the service for denial-of-service attacks or to overload target websites
  • Not attempt to circumvent rate limits or usage restrictions
  • Not reverse-engineer, resell, or redistribute the service except through the provided API on applicable plans
  • Not misrepresent CompliaScan results as a legal compliance certification or audit
  • Comply with all applicable laws in your jurisdiction

4. Account and Billing

Free accounts include limited scans per month as described on the pricing page. Paid subscriptions are billed monthly through Stripe. You can cancel at any time through the billing portal — access continues through the end of the current billing period.

We reserve the right to change pricing with 30 days notice to existing subscribers. Feature availability by plan tier may change, but we will not remove features from a tier you are actively subscribed to without notice.

5. API Usage

API access is available on Pro and Business plans. API keys are subject to rate limiting. You are responsible for securing your API keys. Sharing API keys or using them in ways that exceed your plan limits may result in key revocation.

6. White-Label Reports

Business plans include white-label PDF reports. You may use these reports with your own clients. CompliaScan is not responsible for how you present or use these reports, and the limitations in Section 2 apply regardless of branding. You are solely responsible for any representations you make to your clients about the nature, scope, or legal significance of these reports.

7. Data and Privacy

Your use of CompliaScan is also governed by our Privacy Policy. We scan the publicly accessible content of URLs you submit. We do not access password-protected pages or private content.

8. Intellectual Property

CompliaScan, its logo, and all associated content, software, and documentation are the intellectual property of CompliaScan and its operators. Your subscription grants you a limited, non-exclusive, non-transferable license to use the service for its intended purpose during your subscription term.

Scan results and reports generated for your account are yours to use, subject to these terms. You may not claim ownership of or patent the underlying scanning technology, algorithms, or methodology.

9. Availability and Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or secure, that scan results will be accurate or complete, or that defects will be corrected. We make reasonable efforts to maintain service availability and accuracy but expressly disclaim liability for downtime, missed issues, false positives, or false negatives.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPLIASCAN AND ITS OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Damages from accessibility lawsuits, regulatory investigations, or enforcement actions
  • Lost revenue, profits, or business opportunities
  • Reliance on scan results, scores, or reports for legal or business decisions
  • Data loss or security breaches
  • Service interruptions or downtime

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO COMPLIASCAN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless CompliaScan and its operators, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the service
  • Your violation of these terms
  • Your misrepresentation of scan results as legal compliance certifications
  • Any third-party claims arising from your use of white-label reports
  • Your scanning of websites you do not own or have authorization to scan

12. Dispute Resolution

Any dispute arising from or relating to these terms or the service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association (AAA), with arbitration conducted remotely or in the state of the service operator's principal place of business.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You may opt out of this arbitration clause by sending written notice to legal@compliascan.com within 30 days of first using the service.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Delaware.

14. Termination

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used in a manner harmful to CompliaScan, its users, or third parties. You may close your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy. Sections 2, 9, 10, 11, 12, and 13 survive termination.

15. Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

16. Entire Agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and CompliaScan regarding your use of the service and supersede all prior agreements, understandings, and communications.

17. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of updated terms. If you do not agree with the changes, you must stop using the service and close your account.
